O-1 Visa

A work visa for people with extraordinary ability

The O-1 visa is for individuals who have risen to the top of their field. There is no annual cap and no lottery, which makes it a strong alternative to the H-1B for founders, executives, researchers, artists and other accomplished professionals. An O-1 visa lawyer can help you present your achievements in the way USCIS expects.

Two types of O-1 visa

O-1A covers the sciences, education, business and athletics. You show extraordinary ability through a major award or by meeting at least three criteria, such as awards, membership in selective associations, published material about you, judging the work of others, original contributions, scholarly articles, a critical role at a distinguished organization or high pay.

O-1B covers the arts, film and television, where the standard is distinction or extraordinary achievement.

Key requirements

  • A US employer or agent to file the petition. Founders can be sponsored by their own US company.
  • Strong evidence of your achievements and recognition
  • An advisory opinion from a relevant peer group, labor organization or expert

Length of stay

O-1 status is granted for up to three years at first, and can be extended in one-year increments for as long as the work continues. Your spouse and children can accompany you in O-3 status.

O-1 and green cards

The evidence that supports an O-1 is often a strong foundation for an EB-1 or EB-2 National Interest Waiver green card. We plan both together.
