A first-preference green card for top talent
The EB-1 category is reserved for people at the top of their fields. It does not require labor certification, and one of its subcategories allows you to petition for yourself without a job offer. Your spouse and unmarried children under 21 receive green cards too.
Three EB-1 categories
EB-1A: Extraordinary ability. For people with sustained national or international acclaim in the sciences, arts, education, business or athletics. You can self-petition, without an employer. You show extraordinary ability through a major award or by meeting at least three of the regulatory criteria, such as published material about you, high salary, judging others’ work, original contributions of major significance or a leading role in a distinguished organization.
EB-1B: Outstanding professors and researchers. For academics and researchers with international recognition and at least three years of experience, sponsored by a US university or qualifying research employer.
EB-1C: Multinational executives and managers. For executives and managers who have worked for a related company abroad for at least one year in the three years before coming to the US, and who will work in an executive or managerial role for the US company. Many L-1A visa holders follow this path.
The EB-1 process
- Case assessment. We review your record and choose the strongest category.
- Evidence and petition. We gather evidence and expert letters and prepare a detailed Form I-140 petition.
- Filing. Premium processing is often available for a faster decision.
- Green card. Once a visa number is available for your country of birth, you apply through adjustment of status in the US or consular processing abroad.
Frequently asked questions
Do I need to be famous for EB-1A? No. You need evidence that you are among the small percentage at the top of your field. Many successful applicants are not household names.
Is EB-1 faster than EB-2? Often, because EB-1 can have shorter waits for visa numbers. Timing depends on your country of birth.
